Manila: The Independent Commission for Infrastructure (ICI) has submitted an initial interim report and recommendation to the Office of the Ombudsman regarding the PHP289.5-million flood control project in Naujan, Oriental Mindoro. The report suggests the potential filing of graft, malversation, and falsification charges against former Ako Bicol Party-list Rep. Zaldy Co and 13 officials from the Department of Public Works and Highways.
According to Philippines News Agency, the ICI’s 32-page report highlights discrepancies in the project’s execution, particularly the use of steel sheet piles measuring only 2.5 to 3 meters in length, contrary to the contract’s Detailed Engineering Design which specified 12-meter piles. This variance could result in public losses estimated at over PHP63 million.
The Commission also identified deficiencies in the documentation supporting progress billings. “Several payments were approved despite missing records and, in some instances, identical photographs were reused to justify separate billings,” the ICI noted, suggesting lapses in project verification and questioning the certifications by DPWH officials attesting to compliance with specifications and workmanship.
Zaldy Co has been named for allegedly receiving unwarranted benefits related to construction projects by government contractor Sunwest Inc., a firm reportedly linked to him. Despite Co’s claims of divesting his interests, reports suggest he may still retain beneficial ownership. The Commission emphasized the need for further evidence to establish any definitive connection.
“At this stage, the findings remain preliminary. The ICI has recommended that the Ombudsman evaluate whether potential violations may exist under the Anti-Graft and Corrupt Practices Act, Malversation and Falsification provisions of the Revised Penal Code, the Government Procurement Reform Act, and the Code of Conduct for Public Officials and Employees,” stated the ICI. The Commission plans to submit additional evidence within 15 days and stresses that determining liability is the responsibility of the proper authorities.
In response to the report, Justice Secretary Jesus Crispin Remulla urged Co to “face the music” and address the charges against him.
